Attorney – Consumer Litigation & Debt Collection Defense
Location: Nashville, TN ( Remote)
Reports To: Chief Operating and Legal Officer
Position Overview
We are seeking a licensed Attorney to join our legal team in a dynamic and compliance-driven environment. This role focuses on defending consumer claims and regulatory matters, with an emphasis on debt collection defense and consumer protection litigation.
This is an excellent opportunity for a motivated attorney or emerging legal professional interested in litigation strategy, regulatory compliance, and high-volume case management within a fast-paced business setting.
Key Responsibilities
Litigation & Case Strategy
• Defend lawsuits involving debt collection, consumer protection, and related regulatory claims.
• Develop and implement litigation strategy from initial case evaluation through resolution.
• Draft, review, and file pleadings, motions, discovery responses, and other court submissions in state and federal courts.
• Manage a high-volume caseload while maintaining strategic oversight and compliance.
Court Representation & Resolution
• Appear in court for hearings, mediations, arbitrations, and trials, as appropriate (for licensed attorneys).
• Negotiate settlements, dismissals, and resolutions aligned with company objectives and risk tolerance.
• Attorney – Consumer Litigation & Debt Collection Defense. Coordinate with outside counsel when necessary and oversee performance and budget management.
Compliance & Risk Management
• Advise leadership on litigation exposure, regulatory developments, and risk mitigation strategies.
• Collaborate with compliance, collections, and operations teams to ensure adherence to:
o Fair Debt Collection Practices Act (FDCPA)
o Fair Credit Reporting Act (FCRA)
o Telephone Consumer Protection Act (TCPA)
o Applicable state consumer protection and collections laws
• Oversee discovery processes, including interrogatories, depositions, and document production.
• Review contracts and documentation to ensure litigation preparedness.
• Assist in developing internal policies, procedures, and best practices to minimize regulatory risk.
• Maintain accurate litigation tracking and reporting systems, including forecasting and budget management.
